Introduction
MorningJolt (referred to as "MorningJolt") reserves the right to change or modify this Agreement and any policy or guideline incorporated by reference at any time at its sole discretion.

You (referred to as "User" or "Customer") accept our Terms of Service, detailed herein, upon clicking the checkbox during the registration process (which is required to complete the form). You agree that you've reviewed and understand these terms and conditions in their entirety.

Any changes or modifications will be posted by MorningJolt to www.morningjolt.site/terms and become effective upon posting of the revisions on this document.

You are responsible for regularly reviewing the Site to obtain timely notice of such changes or modifications. Your continued use of the Services following MorningJolt posting of any changes or modifications will constitute your acceptance of such changes or modifications. IF YOU DO NOT AGREE TO THE TERMS OF ANY MODIFICATION, DO NOT CONTINUE TO USE THE SERVICES AND IMMEDIATELY CEASE USAGE.

Service Description
MorningJolt provides personalized ultra-short (15-20 second) video clips primarily designed for WhatsApp status updates. New users receive one free video as a trial under our freemium model.

Upon registration, you will have access to our platform where you can request personalized video content. Delivery times are not guaranteed, but we strive to provide quality content in a timely manner.

MorningJolt operates in India and observes Indian Standard Time (IST) for all operations and delivery timelines.

Subscription and Payment Terms
Our service may offer various subscription plans and one-time purchase options. Pricing information is available on our website.

Freemium Model
- New users are entitled to one free video clip as a trial
- No payment information is required for the free trial video
- Additional videos require payment as per our current pricing structure

 Subscription Service
- If you choose a subscription plan, your subscription will automatically renew at the end of the applicable subscription period
- You may cancel your subscription at any time before the end of the current subscription period
- Cancellation will be effective at the end of the current billing cycle

Payment
- All payments are processed securely through our payment gateway
- Payments are non-refundable except as expressly provided in our refund policy
- You authorize MorningJolt to charge your chosen payment method for the subscription fee on each renewal date
- Your account and access to services may be suspended in the event of non-payment
- You represent and warrant that your payment information is accurate and that you are authorized to use the payment instrument
- You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date)
- MorningJolt may change its fees from time to time by posting the changes on the Site with 5 days prior notice, but with no advance notice required for temporary promotions or reductions in fees

Refund Policy
We offer a satisfaction guarantee for our paid services. If you are not satisfied with the quality of your personalized video, you may request a refund within 48 hours of delivery by contacting team@morningjolt.site.

MorningJolt reserves the right to review refund requests on a case-by-case basis. Refunds are not available for the following:
- Free trial videos
- Videos that have already been used or published
- Requests made after the 48-hour window
- Multiple repeated refund requests that suggest abuse of the policy

 Limitations and Use of Service
MorningJolt is designed for personal use. Our videos are intended primarily for WhatsApp status updates and similar casual social media sharing. We reserve the right to decline requests that:

- Contain explicit, adult, or pornographic content
- Promote illegal activities
- Contain hate speech or discriminatory content
- Infringe on intellectual property rights
- Violate any applicable laws or regulations

If we find that you are sharing accounts/logins, violating our core values, or abusing our services or team in any way, we reserve the right to suspend or terminate your account without refund.

Content Ownership and Rights
User Content
You maintain ownership rights to any personal content you submit to MorningJolt for the creation of your personalized videos. By submitting content to MorningJolt, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of creating your personalized video.

MorningJolt Content
All content created by MorningJolt, including templates, effects, music, and design elements, remains the property of MorningJolt. When we deliver a personalized video to you, you receive a non-exclusive, non-transferable license to use the video for personal social media sharing. You may not:

- Resell or redistribute the video
- Remove any MorningJolt branding or watermarks
- Claim ownership of the template or design elements
- Use the video for commercial purposes unless explicitly permitted

 Portfolio Rights
By default, you agree to provide MorningJolt with a non-exclusive right and license to publish your completed videos in our portfolio, website, social media, email, or other communication efforts, with all personal information removed. If you would like to revoke this right, please notify our team in writing at team@morningjolt.site.

Service Availability and Delivery
MorningJolt strives to maintain uninterrupted service, but we do not guarantee continuous, uninterrupted access to our services. Server maintenance, technical issues, or factors beyond our control may temporarily affect service availability.

While we aim to deliver your personalized videos promptly, delivery times are not guaranteed. Factors such as request volume, complexity, and system capacity may affect delivery times.

Limitation of Liability
To the maximum extent permitted by applicable law, MorningJolt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use or inability to use our service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from our service
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service

BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, OR LIMITATIONS OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THESE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF MORNINGJOLT UNDER THIS AGREEMENT EXCEED THE AMOUNT PAID BY YOU TO MORNINGJOLT DURING THE PAST THREE MONTHS, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER, REGARDLESS OF THE CAUSE OF ACTION, IN TORT, CONTRACT, OR OTHERWISE.

Intellectual Property
The MorningJolt service, including its original content, features, and functionality, is and will remain the exclusive property of MorningJolt and its licensors. The service is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MorningJolt.

Digital Millennium Copyright Act (DMCA)
We respect the intellectual property rights of others. If you believe that material available on our site infringes on your copyright, please provide us with written notice that contains:

- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing
- Information reasonably sufficient to permit us to contact you
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner

Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us at team@morningjolt.site.

Governing Law
These Terms shall be governed by and defined following the laws of India. MorningJolt and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
